LIBERTY TOWNSHIP ZONING COMMISSIONNOTICE OF PUBLIC HEARING The Liberty Township Zoning Commission will meet at 7:30 p.m. on September 29, 2014, at the Liberty Township Hall, 7761 Liberty Road, Powell, Ohio: To hold a Public Hearing in order to consider a Motion adopted by the Liberty Township Zoning Commission, which proposes an amendment to the Liberty Township Zoning Resolution. This proposed amendment is designated as Case Number LTZ #14-05 which, pursuant to Ohio Revised Code Section 519.12, is a proposed amendment to the Liberty Township Zoning Resolution and would, if adopted, add Article XII to the Zoning Resolution and create the POD23 Planned Overlay District (POD23) as a planned unit development under Ohio Revised Code Section 519.021(C) and which would include sections detailing: the purpose and establishment of the POD23; requirements for the POD23, including development tract sizes, permitted uses, open space and prohibited uses; establishment of a review process and procedure for the POD23; requirements for contents of development plans; basis of approval; an approval period; process for modification or extension of development plan; provisions for design standards and minimum development standards including, but not limited to, access, setbacks, yard areas, signage, landscaping, parking, loading, and open space; and provisions for divergences from the minimum development standards. This amendment would also amend Section 5.01 by adding the POD23 as a zoning district in the Zoning Resolution and revising the Zoning Map to designate the POD23 area. In addition, the amendment would incorporate definitions alphabetically into Article IV for certain terms used in the POD23 text. As part of this proposed amendment, three parcels located west of U.S. 23 and north of Hyatts Road are proposed to be rezoned from FR-1 to POD23 Planned Overlay District and those three parcels have the following parcel numbers, acreages, owners, and addresses: 1) Delaware County tax parcel #41944003058000, 37.80000 acres, Greif Packaging LLC, Cornerstone Drive, Delaware, Ohio 43015; 2) Delaware County tax parcel #41944003048000, 9.93000 acres, Greif Inc., 370 Hyatts Road, Delaware, Ohio 43015; and 3) Delaware County tax parcel #41944003050000, 2.92000 acres, Greif Inc., Hyatts Road, Delaware, Ohio 43015. These three parcels are also shown on the POD23 Overlay Zoning District Map which is attached to and made part of the proposed amendment text.The motion proposing to amend the Zoning Resolution, along with the proposed zoning amendment text and map, will be available for public examination beginning September 4, 2014, and continuing through the date of the Public Hearing, Mondays through Fridays, excluding legal holidays, from 9:00 a.m. to 4:00 p.m. at the Liberty Township Government Offices, located at 10104 Brewster Lane, Suite 125, Powell, Ohio 43065. The person responsible for giving notice of this public hearing by both publication and mail is Julie Guy, Liberty Township Zoning Secretary.
